被告等涉犯刑法第277條傷害罪、第294條遺棄罪，請 鈞署偵辦並依法提起公訴。

事實與理由

一、 被告一涉犯傷害行為：
被告一係長生養老院聘僱之看護，於114年12月27日上午，對告訴人之腹部、乳部及手部施加肢體暴力。 告訴人受有深層切割傷，送醫後縫合五針，顯非一般意外或碰撞傷。

二、 被告二人涉犯遺棄罪（違背義務不作為）：
告訴人受傷後大量流血，被告二人均在現場卻未即時給予醫療處置，亦未第一時間送醫，延誤救援達數小時之久。

三、 法律定調與加重處分：

非自傷或意外： 醫院診斷傷口整齊，與機構辯稱之「因巴金森氏症自傷」或「撞傷」明顯不符。

身分弱勢： 告訴人為82歲高齡且雙目失明之重度身障者。 被告等欺凌無自救能力之人，建請依《老人福利法》相關規定加重其刑。

證據保全與調查請求（緊急訴求）

扣押監視影像： 請求 鈞署立即行文扣押「長生養老院」114年12月27日全日之所有監視器影像，以防機構蓄意覆蓋。

調閱出勤紀錄： 請求調閱119救護員之當日出勤紀錄及訪談救護人員，查證傷口特徵之初步證詞。

傳喚證人： 請傳喚當日值班櫃檯護理師及國軍替代役男，釐清拒絕送醫之責任歸屬。

Statement of Complaint

The defendants are suspected of violating Article 277 (assault) and Article 294 (abandonment) of the Criminal Code. We request that your office investigate and prosecute according to law.

Facts and Reasons

I. Defendant 1’s Involvement in Assault: Defendant 1, a caregiver employed by Changsheng Nursing Home, inflicted physical violence on the complainant’s abdomen, breasts, and hands on the morning of December 27, 2025. The complainant suffered deep lacerations requiring five stitches after being taken to the hospital, clearly indicating it was not a typical accident or collision injury.

II. The two defendants are suspected of abandonment (breach of duty due to negligence): After the complainant was injured and bled profusely, both defendants were present but failed to provide immediate medical treatment or take the complainant to the hospital, delaying rescue for several hours.

III. Legal interpretation and aggravated punishment:

Not self-injury or accident: The hospital diagnosis indicated the wound was clean, clearly inconsistent with the institution’s claim of “self-injury due to Parkinson’s disease” or “collision injury.”

Vulnerable status: The complainant is an 82-year-old, blind, and severely disabled person. The defendants bullied someone unable to help themselves; therefore, it is recommended that their punishment be increased in accordance with the relevant provisions of the Elderly Welfare Act.

Request for Evidence Preservation and Investigation (Urgent Request)

Seizure of Surveillance Footage: Request that your office immediately issue a document to seize all surveillance footage from Chang Sheng Nursing Home on December 27, 2025, to prevent the institution from intentionally covering it up.

Review of Attendance Records: Request to review the 119 emergency call center’s attendance records for that day and interview the paramedics to verify their preliminary testimonies regarding the characteristics of the wounds.

Summoning Witnesses: Please summon the nurse on duty at the front desk and the military alternative service member on that day to clarify the attribution of responsibility for refusing to transport the patient to the hospital.

Refusal to Mediation: This case involves abuse and personal safety of the elderly, and the circumstances of the crime are serious. Tell your representative that you solemnly declare that you will not accept mediation and request direct investigation and transfer.

Administrative Notification: Request that your office confirm whether the Social Affairs Bureau’s Domestic Violence Center has been simultaneously notified in accordance with the Elderly Welfare Act.
